No Objection Certificate (NOC)

Introduction

If you are planning to move your vehicle from one state or union territory to another, there are certain legal requirements and paperwork that need to be fulfilled. Each state and union territory has its own Regional Transport Offices (RTOs) that oversee the transfer process and enforce guidelines.

When you intend to relocate to another state or union territory for a period of less than three months, you are not obligated to apply for an address change or re-registration. However, if you plan to stay in the new location for more than a year, it is mandatory to obtain a No Objection Certificate (NOC) from your local RTO for the re-registration of your vehicle.

What is a No Objection Certificate (NOC)?

A No Objection Certificate (NOC) is a legal document issued by the regional RTO that facilitates the re-registration of a vehicle from one state to another. The NOC serves as proof that there are no pending tax dues on the vehicle.

If you are traveling to another state for a duration of less than three months and wish to take your vehicle with you, you are not required to obtain an NOC. However, if you plan to relocate for more than a year, you must apply for a change of address and re-registration. This process necessitates obtaining a NOC from the RTO where your vehicle is currently registered.

Application Process for NOC Certificate

To apply for an NOC certificate, follow these steps:

1. Visit the local RTO in person.
2. Submit a completed CMV 28 form along with the necessary documents.
3. Pay an application fee of Rs.100.
4. After submitting the application, the RTO will obtain a report from the Police authority to verify if the vehicle is involved in any criminal case or reported as stolen.
5. If there are no outstanding dues or pending cases against the vehicle, a clearance receipt is issued and a No Objection Certificate is issued.
6. The RTO will take approximately three business days to issue the NOC Certificate.

Documents Required for NOC Application

The following documents are required when applying for an NOC:

1. Registration certificate (RC)
2. Insurance certificate
3. Permit and fitness certificate (for commercial vehicles)
4. Emission test certificate (pollution under control certificate – PUC)
5. Consent of Financier on CMV form 28 (if the vehicle is covered by Hypothecation, HPA, or a lease agreement)
6. Pencil print of the chassis number for the CMV 28 form
7. Photo identity and address proof

Validity of NOC Certificate

An NOC is valid for a period of six months. After the expiry of the NOC, it cannot be used for re-registration. Therefore, it is important to submit the NOC and required documents to the local RTO of the state you are moving to within six months.

NOC Requirement for Vehicle Sales

Apart from transferring a vehicle from one state to another, an NOC is also required when selling a vehicle to someone who intends to take it to a different state or union territory. Inter-state vehicle transfers in India can be complex, and it is advisable to seek assistance from agencies or vehicle transportation firms that specialize in these procedures.

Road Tax Refund Process

Additionally, the regulations allow you to apply for a refund of the initial road tax paid during the vehicle registration process. The deadline to apply for a refund varies in each state, and you can initiate the process as soon as you move to another state or union territory with the NOC.
